Terms and conditions
THE COMPANY - Bear Clobber

THE CUSTOMER - The person ordering the goods from the Company. All orders are made under these terms and conditions alone and the Company salesman and agents have no authority to make any representation or promise on the Company’s behalf or to vary these terms and conditions.

STATUTORY RIGHTS - Nothing in these Terms and Conditions affects the statutory rights of the Customer.

DELIVERY - All goods quoted for delivery shall be delivered to the Customer. The cost of goods delivered will be charged to The Customer as defined in the details of delivery charges in The Company's current published price list or on the web site.

If you haven't recieved the goods by the 15th working day (day one is counted as the day you recieve your confirmation of completed order email) please contact us via the contact form to advise us.  It is your responsibilty to ensure that sales@bearclobber.com and mail@bearclobber.com email addresses are accepted by your email client, for any return communications.  In any event it is advised that you regularily check your Junk/Spam email folders.

Please note we cannot process any claim against the relevant postal service before the 15th working Day.

All non-deliveries must be advised to us by the 30th day, as notifications after that day cannot be accepted.

All non deliveries notified to us after the 15th working Day and before the 30th Day will be processed by us to make a claim again the relevant postal service.  You will recieve a form that you must complete and we must be in receipt of before we can release any goods as replacements, all postage costs are at your expense.  The address you should return the claim form to is.

PRICES - Prices quoted are those ruling as specified on our website www.bearclobber.com

PAYMENT - Payment can be made via PAYPAL, if you don't have a PAYPAL account you can still pay via your credit card on the PAYPAL screens, or if preferred by credit card (Mastercard/Visa/Switch/Maestro/Solo) over the phone on +44 (0)870 609 4437. Cheques or postal orders are made payable to Bear Clobber prior to delivery.  Please note will not store any financial details of our customers wether that be over the phone or via the website.

RETURNS - Prior to returning goods to us you must contact us for a Returns Authorisation Number (RAN) to obtain a RAN you can either call us on +44 (0)1202 635001 or email sales@bearclobber.com . All returns must be notified to us within 7 days.  PLEASE NOTE, CUSTOM JOCKSTRAPS CANNOT BE RETURNED.

CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000

The Regulations provide customers with a right to cancel an order and state that cancellation of an order must be in writing within 7 working days. The customer is under a duty to restore the goods to the supplier and in the meantime take reasonable care of them.

In respect of defects or shortages discoverable on inspection the Company shall be under no liability if a written complaint is not delivered to the Company within seven days of delivery detailing the alleged defects or shortages unless the shortage is also reported to the carrier on delivery. In respect of defects caused by faulty manufacture, materials or workmanship which are not discoverable on inspection but which are discovered within one month of delivery the Company will either repair the goods or at its cost replace them provided that:

a) The Customer informs the Company of the relevant defect in writing within seven days of discovery and

b) Returns the goods to the Company at its own expense.

The Company shall not be liable for any consequential or indirect loss suffered by the Customer whether such loss arises from breach of a duty in contract or tort or in any other way (including loss arising from the Company’s negligence).

The Company’s total liability for any one claim or for the total of all claims arising from any one act or default of the Company (whether arising from the Company’s negligence or otherwise) shall not exceed the contract price.
